This Privacy Policy governs Braendum’s data collection and usage that it and its affiliates may make of such information. By using Braendum’s Services or accessing this Website, you consent to the data practices described in Braendum’s Privacy Policy as well as Terms of Use and Service and Cookie Policy (collectively, “Terms”). If at any time you find these Terms to be unacceptable or if you do not agree to them, you should not use this Website or hire any Services here offered.
As the data controller, Braendum undertakes to protect the personal data of its customers in accordance with the Swiss Federal Act on Data Protection (FADP) of 25 September 2020 (Status as of 1 September 2023).
Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We only process personal data that you provide to us in connection with the use of our Services or when you visit and/ or contact us through our Website, in accordance with applicable law and only for the purpose of (i) directly providing the service (fulfillment of the contract concluded between Braendum and you, the contract also being considered as actual use of a particular service, without the need to sign anything); (ii) fulfillment of legal (statutory) obligations arising for us from generally binding legal regulations; (iii) prevent threats to your rights and interests; and (iv) other processing that is demonstrably in your interest.
We also process your personal data for the purposes of (i) optimizing, improving the quality and expanding the Services that we provide to you; (ii) granting access to our Services; (iii) paying for our Services; (iv) protecting the legitimate interests of our activities or the interests of our other customers; (v) analyzing visits to our website.
When you provide us with personal information through online forms on the Website, you will always have the opportunity to opt out of receiving marketing and promotional material relating to Braendum Services. However, the ability to opt out of receiving marketing and promotional materials does not affect Braendum’s right to contact you regarding your use of the Website or Services ordered through the Website.

When processing an application for the registration of an intellectual property right or other services related to these, certain owner information will become public. The different local intellectual property registration authorities (government authorities) will publish the owner information of the various intellectual property rights sought to be registered, either through a digital publicly accessible database or physically through paper journals, bulletins, gazettes, or both. The information that will become public is the applicant’s or owner’s full name, nationality, and address.
We may also provide your personal data to third parties without your consent, such as (i) the persons who provide us with the technical operation of a particular Service or the operators of the technologies we use for our Services; (ii) accounting service providers; (iii) providers marketing services.

Braendum shall ensure that it cooperates only with persons located in countries that provide an adequate level of protection of privacy and the fundamental rights and freedoms of individuals under the FADP.
We do not transfer your personal data outside the European Economic Area (EEA) other than to External Third Parties where it is necessary for the performance of the contract with you (for example the use of Trademark registries in foreign countries).
Modification of personal data through the Website will not automatically modify the personal data published by the different local government agencies through which intellectual property rights were applied for or registered.
Braendum is committed to keeping your personal information secure. Therefore, we have implemented adequate physical, technical and organizational measures and plans to protect and secure the collected data (which, however, does not relieve you of your obligation to take appropriate steps to secure your data, especially when transferring your data to us).
The purpose of these measures is to prevent unauthorized or unlawful processing of personal data or accidental, unauthorized or unlawful access, use, transfer, processing, copying, modification, loss or damage to personal data.
Despite our best efforts to comply with applicable laws, we cannot guarantee the security of your personal data if it is transmitted in an insecure manner.

Withdrawal of consent does not affect the processing of personal data that we process on a legal basis other than consent (i.e., especially if the processing is necessary for the fulfillment of the contract, legal obligation or for other reasons specified in the applicable legislation).
You have the right to obtain details about the personal data we process about you and to correct or delete personal data (the right to be forgotten) or to restrict the processing of data concerning you. To exercise these rights, you can contact us at contact@braendum.com. However, if your requests are manifestly unfounded, excessive or repetitive, we reserve the right to refuse them.
We try to respond to all legitimate requests within one month. Occasionally it may take us longer than one month if your request is particularly complex or if you have made several requests. If this happens, we will notify you and keep you updated.
If you believe that your data has been processed unlawfully, please contact us at contact@braendum.com, and we will do our best to resolve the issue. At the same time, you have the right to object to the processing of your personal data and to address your complaint to the supervisory authority, which in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC). We would, however, appreciate the chance to deal with your concerns before you approach the FDIPC so please contact us in the first instance!
